The statute of limitations is a legal time limit within which you must file a lawsuit to seek compensation for your injuries. For personal injury cases in California, the statute of limitations is generally two years from the date you were injured. If the child was under the age of six when they were harmed by medical malpractice, the statute of limitations is three years after the date of the medical negligence or until the child turns eight, whichever comes later.
