Types of Birth Injury Cases We Handle

Some of these injuries are obvious at delivery. Others are not identified for months, when a child fails to reach expected developmental milestones.
When a Birth Injury Becomes a Medical Malpractice Case
Not every difficult delivery or disappointing outcome is the result of negligence. Childbirth carries genuine risk, and some injuries happen even when providers do everything right. A birth injury becomes a legal claim only when a provider fell short of the accepted standard of care and that failure caused harm.
The standard of care is what a reasonably competent provider would have done in the same situation. When a doctor, nurse, or hospital fails to meet it and a baby or mother is injured as a result, a malpractice claim may be possible. Proving one generally requires four things:
- Duty. A provider-patient relationship existed, creating a legal obligation to provide competent care.
- Breach. The provider's care fell below the accepted standard.
- Causation. That failure directly caused the injury, rather than an unavoidable complication.
- Damages. The injury produced real harm, such as medical costs, disability, or the need for lifelong care.
Common failures behind these claims include not monitoring or responding to fetal distress, delaying a medically necessary C-section, misusing delivery instruments, and mismanaging complications like preeclampsia or a cord problem.
Compensation in California Birth Injury Cases
